Please note that this Privacy Policy applies only to information collected through the Service. This Privacy Policy is incorporated in its entirety into the Terms of Service.

By using the Service, you agree to the terms of this Privacy Policy. If you do not agree to this Privacy Policy, do not use the Service. We may amend this Privacy Policy from time to time and, if we do, we will provide notice so that you will always know how we collect, use and disclose your Personal Information.  Your continued use of the Service following the posting of changes to this Privacy Policy will mean that you accept those changes.

1.  Collection of Personal and Non-Personal Information

When you create an Account (as defined in the Terms of Service) or use the Service, you will be providing to us certain information that can be used to identify or contact you, such as your name, email address or other contact information, or your username and password ("Personal Information"). You may review, correct or update your Personal Information at any time by signing into your Account.

In addition, when you use the Service we may log or track information that does not identify you, such as your IP address, browser, click-stream data when you request pages on the Service and the date and time of visit ("Non-Personal Information"). •    To charge you the monthly Premium Member (as defined in the Premium Member Policy) fee, if applicable, or to contact you with respect to matters relating to such fees.
3.  Disclosure of Personal Information

We may disclose your Personal Information to our officers, employees and contractors, and to any third party, when such disclosure is, in our sole discretion:
•    required by law, law enforcement authorities or court order;
•    necessary to protect life, health, or property or the operation of the Service;
•    to prevent exploitation of children; and 
•    as permitted under the Terms of Service.
In the event of a sale, merger or transfer of all or substantially all of our assets to a third party, we may transfer your Personal Information to such third party provided that it agrees to comply with the terms of this Privacy Policy.
4.  Use of Non-Personal Information
We may, in our sole discretion, use and disclose Non-Personal Information for any of the purposes and in any of the circumstances described in Sections 2 and 3 above, and otherwise to provide and improve the Service.
5. Security
The security of your Personal Information is important to us. We utilize commercially reasonable security measures to protect your Personal Information. Nonetheless, because no security measures are completely effective, we cannot ensure or guarantee the security of your Personal Information. In the event of a breach of security with respect to your Personal Information, we will provide any legally required notification to you by posting such notice on the Service or as otherwise required by applicable law.
6. Storage of Personal and Non-Personal Information
All Personal Information and Non-Personal Information that you submit will be transmitted to our servers in Japan. By submitting Personal Information or Non-Personal Information to the Service, you agree to such storage.
7. Children
The Service is not directed and may not be used by children under the age of 13. We do not knowingly collect any Personal Information of children under the age of 13. If we learn that we have collected such information, we will delete any such information promptly thereafter. Parents or legal guardians of children under the age of 13 who may have provided us with Personal Information should contact us at privacy@niconico.com so that we may delete such Personal Information and terminate the relevant Account(s).
8. Advertisers
We may share Personal Information with any advertisers, sponsors and business partners, some of which may belong to the Network Advertising Initiative, which permits consumers to opt out of targeted advertising from all member organizations.
9.  Disclaimer

IN NO EVENT SHALL WE, OR ANY OF OUR SUPPLIERS OR LICENSORS, OR ANY OF OUR OR THEIR CONTRACTORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR PARTNERS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO ANY USE OR DISCLOSURE OF YOUR PERSONAL INFORMATION BY US OR BY ANY USER.

10.    Data Retention

We will retain your Personal Information for as long as your Account is active or as needed to provide you with the Service. If you wish to terminate your Account or request that we no longer use your Personal Information, contact us at Customer Support, as set out below. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
